Welcome to FractionScents.com.

These Terms of Service (“Terms”) govern your access to and use of FractionScents.com, including purchases, customer accounts, product reviews, fragrance-discovery features, promotions, and other services offered through the website.

FractionScents.com is currently operated as a sole proprietorship. Throughout these Terms, “FractionScents,” “we,” “us,” and “our” refer to FractionScents.com and its owner, successors, and permitted assigns.

Please read these Terms carefully before using our website or placing an order.

By accessing or using FractionScents.com, creating an account, submitting content, or purchasing a product—and, where presented, checking the box confirming your agreement to these Terms—you agree to these Terms and the policies incorporated into them.

If you do not agree to these Terms, please do not use the website or complete a purchase.

1. About FractionScents

FractionScents is an independent fragrance sample retailer.

We purchase genuine fragrance products and independently transfer fragrance from authentic original bottles into FractionScents sample atomizers so customers can experience fragrances without purchasing a full-size retail bottle.

Unless specifically stated otherwise on a product page, FractionScents currently sells fragrance samples in 8 mL atomizers.

FractionScents is an independent business and is not affiliated with, sponsored by, endorsed by, authorized by, or otherwise officially connected with the designers, fragrance houses, manufacturers, or trademark owners whose products may be referenced on FractionScents.com.

2. Authenticity of Our Fragrances

FractionScents represents that the fragrances we sell are authentic fragrances sourced from genuine fragrance bottles obtained by FractionScents.

We do not manufacture the original fragrance contained in our samples.

FractionScents independently transfers the fragrance from the original bottle into our own sample atomizers.

Unless a product listing expressly states otherwise:

• The designer or fragrance manufacturer did not bottle the FractionScents sample.
• The designer or manufacturer did not package the FractionScents sample.
• The designer or manufacturer does not manufacture the FractionScents atomizer.
• The sample is not the manufacturer’s original retail presentation.
• The purchase does not include the manufacturer’s original retail bottle, box, packaging, accessories, or promotional materials.

Customers are purchasing an independently prepared FractionScents fragrance sample or decant containing authentic fragrance.

3. Designer Names and Trademarks

Designer names, fragrance names, logos, trademarks, trade dress, and other brand identifiers appearing on FractionScents.com belong to their respective owners.

Names such as Chanel, Dior, Louis Vuitton, Tom Ford, and other designer or fragrance brands may be used solely to accurately identify the fragrance contained in a FractionScents sample and to help customers identify the products being offered.

The use of a third-party brand name does not imply affiliation, sponsorship, authorization, approval, or endorsement of FractionScents by that brand.

FractionScents may establish authorized relationships with fragrance brands or suppliers in the future. If a specific product or relationship is officially sponsored, supplied, or authorized, we may identify that relationship separately.

4. Eligibility and Purchases by Minors

FractionScents.com is a general-audience fragrance-shopping website.

Adults may use the website and place orders directly.

If you are under the age of majority where you live, you may use FractionScents.com and place an order only with the involvement, knowledge, and permission of a parent or legal guardian.

A minor may not use another person’s credit card, debit card, PayPal account, payment credentials, or other payment method without that person’s authorization.

A parent or legal guardian who permits a minor to use FractionScents.com is responsible for supervising that use and authorizing purchases made using the parent’s or guardian’s payment method.

Nothing in this section changes the children’s privacy practices described in our Privacy Policy.

5. Customer Accounts

You may create a customer account on FractionScents.com, although an account is not required to make a purchase.

You are responsible for providing accurate and current account information and for maintaining the confidentiality of your login credentials.

You are responsible for activity occurring through your account to the extent permitted by law.

You may not:

• Create accounts using intentionally false or fraudulent information.
• Impersonate another person.
• Access another person’s account without permission.
• Create accounts to abuse promotions or discounts.
• Manipulate referral, coupon, reward, review, or payment systems.
• Use automated systems to create accounts.
• Use an account for fraud or unlawful activity.

Please contact us promptly if you believe your account has been accessed without authorization.

6. Account Suspension or Termination

FractionScents may suspend, restrict, or terminate an account when we reasonably believe it is necessary because of:

• Fraud or attempted fraud.
• Unauthorized payment activity.
• Chargeback abuse.
• Coupon or promotional abuse.
• Creation of fake or duplicate accounts for improper purposes.
• Security concerns.
• Harassment or abusive conduct.
• Manipulation of reviews or rewards.
• Illegal activity.
• Violation of these Terms.
• Conduct that threatens the security or operation of FractionScents.com.

We may also take reasonable steps to protect the website, customers, payment systems, and our business from fraudulent or abusive conduct.

7. Product Information

We make reasonable efforts to accurately describe the fragrances and products offered on FractionScents.com.

Product descriptions may include information about fragrance notes, scent families, performance, seasons, occasions, perceived style, concentration, recommendations, and other fragrance characteristics.

Some of this information may be based on manufacturer information, industry sources, customer experiences, our own assessment, or general fragrance characteristics.

Fragrance perception is subjective. Product descriptions and recommendations are provided to help customers make purchasing decisions and should not be interpreted as a guarantee that every customer will experience a fragrance in the same way.

8. Fragrance Performance and Personal Preference

How a fragrance smells, develops, projects, and performs can vary from person to person.

Factors may include skin chemistry, application method, temperature, humidity, environment, storage, individual perception, amount applied, and other circumstances.

FractionScents does not guarantee:

• That you will personally like a fragrance.
• That a fragrance will smell the same on every person.
• A specific number of hours of longevity.
• A particular level of projection or sillage.
• A specific number of compliments.
• That another person’s fragrance experience will match yours.
• That a fragrance will perform exactly as described in a review, video, recommendation, or other third-party content.

Fragrance recommendations and categories on FractionScents.com are intended to help you discover products and are not guarantees of personal preference or performance.

9. Fragrance Discovery Features

FractionScents may provide fragrance-discovery tools, categories, quizzes, recommendations, recently viewed products, wishlists, favorites, and similar features.

These tools are designed to make it easier to discover fragrances based on characteristics such as scent profile, occasion, mood, projection, or personal preference.

Recommendations are provided for informational and shopping-assistance purposes only.

A recommendation does not guarantee that you will like a particular fragrance or experience a particular result.

10. Fragrance Safety

Fragrance products sold by FractionScents are intended for external use.

Customers should:

• Avoid contact with eyes and other sensitive areas.
• Keep fragrance away from open flames, sparks, excessive heat, and other ignition sources.
• Keep fragrance securely stored when not in use.
• Use fragrance only as reasonably intended.
• Discontinue use if irritation or an unexpected reaction occurs.

Do not intentionally ingest fragrance products.

Individual sensitivities and allergies can vary. Customers are responsible for reviewing ingredients or manufacturer information when they have a known sensitivity or concern about a particular fragrance ingredient.

Nothing on FractionScents.com constitutes medical advice.

11. Order Acceptance

Submitting an order does not mean that FractionScents is required to accept or fulfill that order.

We reserve the right, when reasonably necessary, to refuse, limit, cancel, or place additional review on an order because of circumstances such as:

• Suspected fraud.
• Unauthorized payment activity.
• Payment-processing problems.
• Inventory errors.
• Website or pricing errors.
• Coupon or promotion abuse.
• Security concerns.
• Unusually large or suspicious purchasing activity.
• Suspected violation of these Terms.
• Product unavailability.
• Shipping restrictions.
• Other legitimate business or legal reasons.

If we cancel an order after payment has been successfully collected and no product will be provided, we will reverse or refund the applicable payment as appropriate.

12. Bulk Purchases and Resale

FractionScents does not prohibit customers from purchasing larger quantities of products for lawful resale.

However, purchasing products from FractionScents for resale does not make the purchaser an authorized representative, distributor, franchisee, agent, partner, or employee of FractionScents or of any fragrance manufacturer.

Resellers are independently responsible for complying with laws, taxes, advertising requirements, labeling requirements, marketplace rules, and other obligations applicable to their resale activity.

Unless FractionScents gives express written permission, a reseller may not represent that FractionScents sponsors, authorizes, endorses, or operates the reseller’s business.

Resellers also may not use FractionScents trademarks, copyrighted material, product photography, original descriptions, branding, or other protected materials except as authorized by law or with our written permission.

13. Prices

Prices displayed on FractionScents.com are stated in U.S. dollars unless otherwise indicated.

We may change product prices at any time before an order is placed.

A price change does not affect an order that has already been validly accepted, except where correction is permitted by applicable law or where an obvious technical, typographical, or pricing error occurred.

Although we make reasonable efforts to maintain accurate pricing, mistakes can occur.

If a product is accidentally displayed at a materially incorrect price because of a technical, typographical, system, or human error, FractionScents may correct the error and, where appropriate, cancel the affected order.

If payment has already been collected for an order we cancel because of a pricing error, the applicable payment will be refunded or reversed.

14. Payment

FractionScents currently accepts payments through payment providers made available during checkout, including PayPal.

Payment services may be operated by independent third parties and may have their own terms, conditions, privacy policies, fraud-prevention systems, and eligibility requirements.

FractionScents does not store complete credit or debit card numbers on its own servers.

You represent that you are authorized to use any payment method submitted for a purchase.

15. Taxes

Customers are responsible for applicable taxes associated with their purchases.

FractionScents may calculate, collect, and remit sales tax or other applicable taxes where required by law.

Taxes generally do not count toward promotional or free-shipping purchase thresholds unless expressly stated otherwise.

16. Free Shipping

Unless otherwise stated in a specific promotion, FractionScents offers free shipping on eligible orders with a merchandise subtotal of $69 or more.

Eligibility is determined using the qualifying merchandise subtotal before the application of coupon or promotional discounts.

For example, if qualifying products total $75 before a coupon is applied and a coupon reduces the amount actually paid below $69, the order may still qualify for free shipping because the merchandise subtotal before the coupon met the $69 requirement.

Taxes and shipping charges do not count toward the $69 merchandise subtotal.

Additional shipping requirements, carrier information, exclusions, delivery information, and other shipping rules are described in our Shipping Policy.

17. Coupons, Discounts, and Promotions

FractionScents may offer coupons, promotional codes, sales, special pricing, free gifts, loyalty incentives, or other promotions.

Unless otherwise stated, promotions may be subject to conditions such as:

• Expiration dates.
• Minimum purchase requirements.
• One use per customer.
• One use per account.
• Product or brand exclusions.
• Quantity limitations.
• Geographic restrictions.
• Specific eligibility requirements.
• Restrictions on combining multiple promotions.

Promotional codes have no cash value unless required by law.

FractionScents may refuse or cancel a promotion when reasonably necessary because of fraud, misuse, technical errors, unauthorized distribution, manipulation, or publication of an offer in error.

FractionScents may modify or discontinue future promotions at any time.

Changes will not retroactively remove a benefit from a completed qualifying transaction unless permitted by law or the transaction resulted from fraud, abuse, or an obvious error.

18. Gift Cards, Store Credit, Loyalty, and Rewards

FractionScents may offer gift cards, store credit, loyalty programs, reward points, referral benefits, or similar programs in the future.

When offered, these programs may be governed by additional terms presented with the applicable program.

Unless otherwise required by law, rewards, promotional credits, points, and similar promotional benefits:

• May be subject to eligibility requirements.
• May have redemption restrictions.
• May not be transferable.
• May not be redeemable for cash.
• May be adjusted or reversed in cases of fraud, cancellation, chargeback, abuse, or error.

Gift cards and paid store-value products will be administered in accordance with applicable law and any specific terms disclosed when they are offered.

19. Refunds, Returns, and Exchanges

Purchases from FractionScents are subject to our separate Refund & Return Policy, which is incorporated into these Terms.

Because FractionScents fragrance samples are individually prepared and packaged personal-use products, all sales are final except where applicable law requires otherwise.

FractionScents does not generally accept returns, exchanges, or refunds because a customer changed their mind, dislikes a fragrance, expected different performance, ordered the wrong fragrance, or no longer wants the product.

Problems such as defective atomizers, damaged shipments, incorrect products, or other order issues will be handled according to our Refund & Return Policy.

A malfunctioning spray mechanism does not necessarily mean that the fragrance itself is defective. FractionScents may provide a replacement atomizer and transfer solution when appropriate.

20. Shipping

Orders are shipped according to the terms of our separate Shipping Policy, which is incorporated into these Terms.

FractionScents may use carriers such as USPS, UPS, FedEx, or other shipping providers.

Customers are responsible for providing a complete and accurate delivery address.

Shipping estimates are estimates and are not guarantees unless expressly stated otherwise.

Carrier delays and circumstances outside FractionScents’ reasonable control may affect delivery times.

21. Reviews and Customer Content

Eligible customers may be permitted to submit product reviews, ratings, photographs, comments, or other content to FractionScents.com.

FractionScents welcomes honest customer opinions, whether positive or negative.

We do not require a customer to provide a positive review.

We may reject or remove content for legitimate reasons, including when content:

• Is spam.
• Is fraudulent or fabricated.
• Does not relate to the product or customer experience.
• Contains threats or harassment.
• Is obscene or unlawful.
• Contains another person’s private information.
• Infringes copyrights, trademarks, privacy rights, or other rights.
• Contains malicious code or harmful links.
• Impersonates another person.
• Contains clearly false or misleading factual claims.
• Was submitted through manipulation of the review system.

We will not remove an otherwise lawful and genuine review merely because the customer expressed a negative opinion about FractionScents or a product.

22. Ownership and License for Reviews and Photos

You retain whatever ownership rights you have in original reviews, photographs, comments, and other content you submit.

By voluntarily submitting content to FractionScents, you give FractionScents a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, resize, publish, distribute, and use that submitted content in connection with FractionScents and its products.

This permission may include displaying your review or photograph:

• On FractionScents.com.
• On FractionScents product pages.
• In FractionScents emails.
• On FractionScents social-media accounts.
• In digital advertising.
• In other FractionScents promotional or marketing materials.

This license does not transfer ownership of your content to FractionScents.

When reasonably practical, FractionScents may display the name, username, or other identifier associated with the original review.

By submitting a photograph or other content, you represent that you own the content or have the necessary permission to submit it and grant the rights described above.

23. Authenticity of Reviews

Product reviews should reflect genuine experiences.

You may not:

• Submit fake reviews.
• Pretend to be another customer.
• Submit reviews for products you did not purchase when the review system requires a verified purchase.
• Use bots or automated tools to create reviews.
• Buy or sell fake reviews.
• Coordinate fraudulent reviews.
• Manipulate ratings.
• Submit reviews for the purpose of misleading customers.

If FractionScents ever offers an incentive for submitting a review, the incentive will not require the review to express a particular positive or negative opinion, and any disclosure required by applicable law must be made.

24. Suggestions, Scent Requests, and Ideas

FractionScents welcomes scent requests, product suggestions, collection ideas, feature suggestions, promotional ideas, feedback, and other voluntary suggestions.

Unless we have entered into a separate written confidentiality agreement with you, suggestions submitted to FractionScents are not considered confidential.

By voluntarily submitting an unsolicited suggestion or idea, you understand that:

• FractionScents may consider or decline the suggestion.
• FractionScents may already be developing a similar idea.
• FractionScents may independently develop a similar idea in the future.
• FractionScents may use the suggestion without compensation or royalty.
• Submission does not create an employment, partnership, agency, fiduciary, or confidential relationship.

This section does not transfer ownership of copyrighted works that applicable law does not permit us to acquire through standard website terms.

25. FractionScents Intellectual Property

Except for third-party trademarks and materials belonging to their respective owners, the original content of FractionScents.com may be owned by or licensed to FractionScents.

This may include:

• FractionScents branding and logos.
• Original product photography.
• Original graphics.
• Website layouts and visual designs.
• Original product descriptions.
• Written content.
• Blog content.
• Fragrance guides.
• Original category structures and presentation.
• Quiz and fragrance-discovery content.
• Marketing materials.
• Database organization.
• Original website features and compilations.

Unless permitted by law or expressly authorized in writing by FractionScents, you may not reproduce, republish, distribute, sell, commercially exploit, modify, or create unauthorized copies of protected FractionScents materials.

No ownership rights are transferred to you simply because you access the website.

26. Automated Scraping, Bots, and Data Extraction

Except for ordinary indexing by legitimate public search engines or activity expressly authorized in writing by FractionScents, you may not use automated or systematic methods to access, monitor, download, copy, extract, harvest, or reproduce content or data from FractionScents.com.

Prohibited methods may include:

• Bots.
• Crawlers.
• Scrapers.
• Spiders.
• Automated browser systems.
• Scripts.
• Data-mining tools.
• Automated APIs not provided or authorized by FractionScents.
• Similar automated technology.

This prohibition applies to, among other things:

• Product catalogs.
• Pricing.
• Product descriptions.
• Product images.
• Reviews.
• Customer information.
• Website content.
• Product availability information.
• Databases.
• Fragrance categories and compilations.

You may not circumvent technical restrictions, access controls, rate limits, robots instructions, security systems, or other measures intended to protect FractionScents.com.

27. Artificial Intelligence and Machine-Learning Use

Unless FractionScents provides prior written permission, FractionScents content may not be systematically scraped, copied, extracted, or used to create datasets for the purpose of developing or operating artificial-intelligence or machine-learning systems.

This includes using protected FractionScents content to:

• Train an AI model.
• Fine-tune an AI model.
• Benchmark a model.
• Evaluate a model.
• Build a commercial AI database.
• Ground or populate a commercial AI system.
• Create an unauthorized competing product database.
• Reproduce substantial portions of the FractionScents catalog through automated systems.

Nothing in this section prohibits activities that applicable law does not permit FractionScents to restrict.

28. Prohibited Website Uses

You may not use FractionScents.com:

• For an unlawful purpose.
• To commit or facilitate fraud.
• To impersonate another person.
• To submit false payment information.
• To gain unauthorized access to accounts or systems.
• To introduce viruses, malware, or harmful code.
• To interfere with website functionality.
• To attack or overload our servers.
• To harvest customer information.
• To send spam.
• To manipulate reviews or ratings.
• To manipulate coupons, promotions, loyalty benefits, or referrals.
• To fabricate consent or opt-out records.
• To improperly initiate or manipulate chargebacks.
• To infringe the rights of FractionScents or another party.
• To circumvent website security controls.
• To engage in automated scraping prohibited by these Terms.

We may restrict access when reasonably necessary to prevent prohibited activity.

29. Affiliate Program

FractionScents may operate an affiliate program through which approved affiliates can earn commissions for qualifying referrals or sales.

Participation in the FractionScents affiliate program is governed by separate Affiliate Program Terms.

Becoming a FractionScents customer does not automatically make you an affiliate.

Affiliate participation does not create an employment, partnership, franchise, joint venture, or agency relationship unless a separate written agreement expressly states otherwise.

30. Third-Party and Affiliate Links

FractionScents.com may contain links to third-party websites.

For example, FractionScents may provide links allowing customers interested in a fragrance sample to visit a third-party retailer that sells the corresponding full-size bottle.

Some links may be affiliate links. FractionScents may receive a commission or other benefit if you make a qualifying purchase through certain affiliate links.

Unless specifically stated otherwise, an affiliate relationship does not mean FractionScents controls the third-party retailer.

FractionScents is not responsible for an independent third party’s:

• Website.
• Product inventory.
• Prices.
• Shipping.
• Returns.
• Customer service.
• Security.
• Privacy practices.
• Terms.
• Products or services.

Purchases made directly from a third-party website are transactions between you and that third party and are subject to that third party’s policies.

31. Social Media and Embedded Content

FractionScents may link to or display content from platforms such as Instagram, Facebook, TikTok, YouTube, X, and other services.

These platforms are operated independently from FractionScents.

Your interactions with third-party platforms are governed by their own terms and privacy practices.

32. Email Communications

When you place an order or maintain an account, FractionScents may send transactional communications such as order confirmations, shipping updates, account notices, security information, and customer-service responses.

If you separately choose to receive promotional emails, FractionScents may send marketing communications about products, new fragrances, promotions, recommendations, or other FractionScents news.

You may unsubscribe from promotional emails using the unsubscribe method provided in the message.

Unsubscribing from promotional emails does not prevent necessary transactional or account-related communications.

33. SMS Communications

If you voluntarily opt in to SMS marketing, FractionScents may occasionally send promotional text messages.

FractionScents does not currently operate SMS marketing as a continuously recurring automated messaging program.

Providing a telephone number solely for an order, shipping, customer account, payment verification, or customer-service purpose does not by itself constitute consent to promotional text messages.

You may withdraw consent to marketing messages using the opt-out method provided with the message or by contacting FractionScents.

Message and data rates may apply depending on your mobile provider and plan.

34. Privacy

Our collection, use, sharing, retention, and protection of personal information is described in the FractionScents Privacy Policy.

The Privacy Policy is incorporated into these Terms where applicable.

35. Website Availability

We work to keep FractionScents.com available and functioning properly, but we do not guarantee uninterrupted availability.

The website or particular features may occasionally be unavailable because of:

• Maintenance.
• Updates.
• Hosting problems.
• Internet outages.
• Security incidents.
• Software problems.
• Third-party failures.
• Events outside our reasonable control.

We may modify, suspend, replace, or discontinue website features when reasonably necessary.

36. Errors and Inaccuracies

Despite reasonable efforts, information on FractionScents.com may occasionally contain errors, omissions, outdated information, or technical problems.

These may involve:

• Product information.
• Pricing.
• Availability.
• Promotions.
• Shipping information.
• Images.
• Fragrance descriptions.

We may correct errors when discovered.

Nothing in this section allows FractionScents to avoid an obligation or consumer right that applicable law does not permit us to disclaim.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FRACTIONSCENTS.COM AND ITS WEBSITE, CONTENT, FEATURES, AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

WE DO NOT GUARANTEE THAT THE WEBSITE WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR FREE OF HARMFUL COMPONENTS.

WE DO NOT GUARANTEE THAT EVERY PRODUCT, DESCRIPTION, RECOMMENDATION, REVIEW, OR FRAGRANCE-DISCOVERY RESULT WILL MEET EVERY CUSTOMER’S INDIVIDUAL EXPECTATIONS.

NOTHING IN THESE TERMS EXCLUDES ANY WARRANTY, RIGHT, OR REMEDY THAT CANNOT LEGALLY BE EXCLUDED.

38. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FRACTIONSCENTS AND ITS OWNER, SUCCESSORS, SERVICE PROVIDERS, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF FRACTIONSCENTS.COM, EXCEPT WHERE SUCH A LIMITATION IS PROHIBITED BY LAW.

THIS MAY INCLUDE, TO THE EXTENT LEGALLY PERMITTED, LOSS OF DATA, LOSS OF PROFITS, LOSS OF BUSINESS OPPORTUNITY, OR DAMAGES ARISING FROM THIRD-PARTY WEBSITES OR SERVICES.

TO THE FULLEST EXTENT PERMITTED BY LAW, FRACTIONSCENTS’ TOTAL LIABILITY ARISING FROM A PARTICULAR PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID TO FRACTIONSCENTS FOR THE ORDER GIVING RISE TO THE CLAIM.

FOR A CLAIM RELATING SOLELY TO USE OF THE WEBSITE AND NOT TO A PURCHASE, FRACTIONSCENTS’ TOTAL LIABILITY WILL NOT EXCEED $100, TO THE EXTENT SUCH A LIMIT IS PERMITTED BY LAW.

These limitations do not apply where applicable law prohibits them, including liability that cannot lawfully be waived or limited.

39. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless FractionScents and its owner, successors, service providers, contractors, and agents from third-party claims, losses, liabilities, damages, costs, and reasonable legal expenses arising from your:

• Unlawful use of FractionScents.com.
• Fraud or intentional misconduct.
• Material violation of these Terms.
• Infringement of another person’s rights.
• User content that you did not have the right to submit.
• Unauthorized use of FractionScents intellectual property.
• Resale activity that falsely represents an affiliation with FractionScents or a fragrance brand.

40. Informal Dispute Resolution
